Why the Property Rights Tribunal?

The Property Rights Tribunal's mission is to independently and professionally document and report on property rights violations in Türkiye, based on standards and principles elaborated by international courts and utilizing best practices from national courts.

About Us

The Property Rights Tribunal will be held in 2026

The Turkish Tribunal, established in 2021 to prosecute and report on torture and crimes against humanity committed by Turkey and composed of respected legal experts, academics, and public officials from around the world, has now set out to prosecute the massive property rights violations in Turkey.

Organizational Structure of the Property Rights Tribunal

The Steering Committee

The Turkey Tribunal is an Opinion Tribunal. It is neither a regular court subject to a State’s judicial system, nor a court established by a Treaty or an international organisation. It is a Tribunal established by civil society and serves as an instrument and platform to give recognition, visibility and a voice to people who allegedly suffer(ed) violations of their fundamental rights.

The Judges

The mission of the Property Rights Tribunal is to assess and report in an independent and professional manner, based on the standards and principles elaborated by other international courts and tribunals and drawing on the experience of the best practices of national courts, all allegations of human rights violations taking place under the jurisdiction of Turkish authorities.

The Rapporteurs

The mission of the Property Rights Tribunal is to assess and report in an independent and professional manner, based on the standards and principles elaborated by other international courts and tribunals and drawing on the experience of the best practices of national courts, all allegations of human rights violations taking place under the jurisdiction of Turkish authorities.

The Registrars

As per Article 7 of the Rules of Procedure, the court designates 4 registrars for the registry

The Observers

The role of the observers is to observe the proceedings, to follow the rules of procedure, to check if all participants (rapporteurs, witnesses, government, third parties if any) can express themselves freely and are treated in a fair way.

Themes of the Tribunal

All documents and the testimonials of the judges will be published in full transparency through modern digital means of communication.

In parallel with the devastating decline in the rule of law and democracy in Türkiye over the last decade, numerous violations of property rights have also occurred. The main areas where systematic property rights violations have occurred are:

Institutional Closures Carried out Through Statutory Decrees
Since 2016, a total of 3942 institutions have been closed or seized in Turkey due to emergency decrees and administrative decisions. The assets of these institutions were transferred to the state treasury. These institutions, which can be categorized into 16 types, were closed or seized as part of 'extreme' measures that are incompatible with democratic values.

Appointment of Trustees to Companies
Since 2015, the Savings Deposit Insurance Fund (TMSF) has appointed trustees to 1,371 companies, including Boydak Holding, Koza-İpek Holding, Naksan Holding, and AKFA Holding, some of Türkiye's leading companies. The companies' economic value has decreased by 62% under the TMSF's management.

Confiscation of Companies
Courts acting under the influence of politics have confiscated the assets of numerous companies and transferred them to the state treasury. Among the confiscated companies are major Turkish companies such as Koza-İpek Holding.

Violations of Individual Property Rights
Systematic violations of property rights against individuals have been identified under 50 headings in various areas, such as keeping individuals dismissed from their jobs through statutory decrees and keeping them in the social security system through practices such as Codes 36 and 37, making it difficult for them to find a job, and arbitrarily closing their bank accounts.

Closure of Educational Institutions Abroad
Many schools and educational institutions affiliated with the Gülen Movement that were opened abroad were forced to close due to pressure from Turkey.

Transfer of Educational Institutions to the Maarif Foundation
Approximately 260 schools belonging to the Gülen Movement abroad were forced to hand over their management to the Turkish state-owned Maarif Foundation due to pressure from Turkey.
